Terms and Conditions

1.Application

1.2 These terms and conditions will apply to the purchase of the goods by you (the customer or you) from Michelle Brown trading as Vigouroots of Falmouth Close, Torquay, Devon, TQ27SE with email address [email protected]; telephone number 07703 388 224 (the supplier, me, us or we)

1.3 These are the terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.

1.4 Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects you. Please read Our Privacy Policy carefully before using Our Service.

2. Interpretation


2.1 Buyer
means an individual, company or group whose order for goods is accepted by the seller.

2.2 Goods means the products (including any item of the goods which the seller is to supply in accordance with these conditions).

2.3 Seller or Company means Michelle Brown trading as Vigouroots referred to as ‘the Company’, ‘we’, ‘me’, ‘us’ or ‘our’ in this agreement.

2.4 Conditions means the standard terms and conditions of sale set out in this document.

2.5 Contract means the contract for the purchase and sale of goods.

2.6 Service refers to the Website

2.7 Terms and Conditions (Also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

2.8 Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

2.9 Website refers to Vigouroots, accessible from https://vigouroots.co.uk

3.Goods and Receiving Goods

3.1 
Some products are recommended by Vigouroots to be kept chilled. You acknowledge that chilled goods may be delayed in transit and/or may be kept in prolonged conditions not recommended by us. In such case, please first chill the fermented products, then slowly and carefully open over the sink in case of gas build-up and spill.

3.2 You understand that leakage may occur, during transit and upon receipt. This does not compromise the product and is normal. This may happen as Vigouroots fermented products are very much alive and will continue to ferment, and faster under warmer conditions, such as in transit. As the jars are full, the extra liquid produced by fermentation may leak out. In such case, please open carefully, clean the jar and refrigerate.

3.3 You understand that fermented products will perish faster when not kept below 8 degrees Celsius.

3.4 We endeavour to send parcels out as soon as possible, and you accept that you have a responsibility to provide an accurate address and have someone available to take in the parcel and ensure any fermented products are placed in a chilled environment. You indemnify us against any liability for the products in any case where they are not delivered due to errors or omissions in the information you provide us or in any case where the delivery driver is unable to leave the parcel at the address given regardless of any notes such as ‘no signature required’ or noted to leave without signatures.

ORDERS PLACED AFTER  WEDNESDAY WILL BE SENT OUT ON THE FOLLOWING MONDAY. THANK YOU FOR YOUR PATIENCE.

3.5 You accept responsibility to inspect your products for signs of damage or spoilage and report any concerns within 24 hours.

3.6 We recommend having someone to receive the parcel, or leaving a note to ask the driver to place the parcel in a safe place, in the shade/coolest place possible. We accept no responsibility for missing parcels.

3.7 Vigouroots takes great care in creating fresh, raw and tasty fermented products and to package and deliver them as safely and fast as possible. Please ensure you give us the correct mailing information as are able to accept delivery. Thank you and enjoy!

4. Basis of Sale

4.1
The description of the goods on our website or other forms of advertisement does not constitute a contractual offer to sell the goods.

4.2
When an order has been made, we can reject it for any reason, although we will try to tell you the reason without delay.

4.3
A Contract will be formed for the goods ordered, upon the Supplier sending an email to the customer stating that the order has been accepted or if earlier, the Supplier’s delivery of the goods to the customer.

4.4
No variation of the contract, whether about description of the goods, price or otherwise, can be made after it has been entered into unless the variation is agreed by the customer and supplier in writing.
5. Governing law, jurisdiction and complaints

5.1  The Contract (including any non-contractual matters) is governed by the law of England and Wales.

5.2
 If You have any concern or dispute about the Goods or Service, You agree to first try to resolve the dispute informally by contacting the Company. If the item is damaged, defective or incorrect upon receipt contact us as soon as possible so the issue can be resolved. We will ask for photographs of the defective product. Please contact us at [email protected]

In a case where disputes are not resolved by you and the supplier, they can be submitted to the jurisdiction of the courts of England and Wales or, where the customer lives in Scotland or Northern Ireland, in the courts respectively Scotland or Northern Ireland.

4.2 Non-returnable items

Perishable and opened food products are non-returnable. Please do not return your items.

Refund policy

6. Refunds

We will endeavour to reply to your email as soon as possible and discuss the outcome of the refund request.

If approved, you will be refunded immediately to your original payment method. It may take some time for the refund to process back to your account.

6. Links to Other Websites

6.1 Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

6.2 The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

6.3 We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

7. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.
